By accessing or using the Hedayaa website www.hedayaa.com By using the Hedayaa application available on iOS and Android systems or any of the services associated with them ("the services"), you agree to comply with these terms and conditions ("the terms"). These terms apply to all visitors, users, customers, and others who access or use the services. If you do not agree to these terms, you must stop using the services immediately.
Hedayaa reserves the right to modify these terms at any time. The updated version will be published on the website, app, or any other appropriate means. Your continued use of the services after any changes are posted means you accept the modified terms.
2. User Obligations
As a user of the services, you agree to:
Use of the site, application, and services in accordance with all applicable laws and regulations.
Providing accurate, precise, and up-to-date information when registering, submitting applications, or completing purchases.
Not engage in any fraudulent, malicious, or illegal activities.

Hedayaa may provide a mobile application for iOS and Android systems to facilitate access to its services, manage orders, track projects, receive notifications, and complete some procedures related to the services.
The user is responsible for ensuring that the latest available version of the application is used to guarantee the best performance and user experience. Hedayaa may occasionally release updates for the application, and some features may require the application to be updated in order to function properly.
Hedayaa does not guarantee that the application will be available without interruption or free of errors at all times, and the operation of the application may be affected by factors beyond our control, such as internet connectivity, device settings, operating system updates, third-party services, or app store requirements.
6. App Stores
The Hedayaa app may be downloaded from third-party app stores, such as the Apple App Store or Google Play. The download and use of the app are also subject to the terms and policies of the store from which the app was downloaded.
Hedayaa is not responsible for any restrictions, requirements, malfunctions, or decisions issued by app stores, operating systems, or related service providers, to the extent that they are outside of Hedayaa's direct control.
7. Notifications and Messages
Hedayaa may send notifications or messages through the app, email, text messages, or communication applications for service-related purposes, such as order confirmations, project updates, invoices, alerts, support, or important announcements.
The user can disable app notifications from their device settings; however, disabling notifications may result in not receiving some real-time updates related to the service.
8. Intellectual Property Rights
All content, logos, graphics, texts, images, videos, and other materials displayed on the website or application or within the services ("content") are owned by Hedayaa or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, or use the content in any way without explicit written permission from Hedayaa.
You are granted a limited, non-exclusive, non-transferable right to access the services and use their content for personal and non-commercial purposes only, in accordance with these terms.
9. Purchases, Cancellations, and Refunds
When making a purchase through the website or app, you agree to the following cancellation and refund policy:
Hedayaa’s clients have the right to cancel their order before the project execution begins. The project starts after the invoice and the well plaque template are sent by Hedayaa’s follow-up department.
Clients may cancel their order within three days from the date of receiving the invoice and plaque template.
If the order is canceled within this period, the full amount paid will be refunded to the client within a maximum of 15 business days.
After the three-day period, no refunds will be issued..

10. Payments
Payments can be completed through the website or app using secure and approved payment service providers, including PayPal and Amazon Payment Services, or any other payment providers that Hedayaa may adopt from time to time.
Payment transactions are also subject to the terms and policies of the payment service provider chosen by the user. Hedayaa does not store full bank card details on its own systems.
Some information related to payment and demand may be processed for the purposes of completing the transaction, issuing invoices, executing the project, processing cancellation or refund requests, preventing fraud, complying with accounting and legal requirements, and maintaining necessary operational records.
11. Project Execution Terms and Quality Assurance
The client is provided with a photographic report documenting all stages of execution or construction after the project is completed, depending on the nature of the project and the required service.
Hedayaa reserves the right to change the project implementation location to the area of greatest need, or to a more suitable location for execution, which may result in an extension of the implementation period.
All our projects include a 5-year warranty, along with free maintenance every 6 months, depending on the nature of the project and the associated operational conditions.
The duration of project execution ranges from 40 to 60 days from the date of payment, and the duration may vary depending on the nature of the project, the location of execution, field conditions, operational requirements, or any factors beyond Hedayaa's control.
Hedayaa has the right to publish photos and videos of the projects on social media, the website, the application, or marketing materials, while concealing the client's name or any visible personal data, unless the client requests not to publish.
12. Third-Party Services
Hedayaa may rely on services or systems from third parties to operate the website and application, process payments, send notifications, manage accounts, perform analytics, provide hosting, offer technical support, or improve service performance.
These services may include, but are not limited to, Odoo, Google Cloud, Firebase, Webkul Software, Zumra Web Design & Marketing Management - FZCO, PayPal, Amazon Payment Services, or other service providers that Hedayaa may rely on from time to time.
Hedayaa is not responsible for any interruption, malfunction, or change in third-party services beyond its direct control, except to the extent required by applicable law.
13. Privacy Policy
We value your privacy and are committed to protecting your personal information. Please refer to the privacy policy of Hedayaa for detailed information on how we collect, use, and protect your data when using the website, application, or any of the associated services.

To the fullest extent permitted by law, Hedayaa will not be held liable for any indirect, incidental, or consequential damages resulting from your use of or inability to use the Website, its services, or its Content.
The Website and its Content are provided "as is" without any warranties, express or implied, including but not limited to warranties of accuracy, reliability, merchantability, or fitness for a particular purpose.
Hedayaa does not guarantee that the services will be available without interruption or free of errors, or that any malfunction will be corrected immediately, especially in cases related to third-party services, internet connectivity, device settings, or circumstances beyond Hedayaa's control.
15. Termination of Service Use
We reserve the right to suspend or terminate your use of the site, application, or services at any time at our sole discretion, without prior notice or legal liability, in the event of a violation of these terms, misuse of the services, or if there are security or operational reasons that warrant such action.

These Terms and Conditions shall be governed and construed in accordance with the laws of the Hashemite Kingdom of Jordan, without regard to its conflict of law provisions.
